A conveyancer's proximity to you and ease of access matters; if further away that may dramatically inconvenience you, so rather select one who is closer. Once you have found some conveyancers situated near to you, here is a checklist of things to consider and ask them, to help you assess which property lawyer is best (best done before appointing them!):
- Is the Attorney a qualified conveyancer? Get their member number and check it against the Legal Practice Council's list of conveyancing practitioners.
- How much experience does the conveyancer have, especially with conveyancing in your area?
- Are they located close to the Deeds Office in Cape Town. As much as you want them to be close to you, this is also important, as they'll need to physically be delivering documents to the Deeds Office.
- Request a quote for the total transfer costs at an estimated purchase price of the property; broken down into its component parts; and ask whether there are any fees which may vary. Compare it against standard transfer costs. Check what the attorney tranfer fee is. Ask them whether they are open to negotiating the fees.
- Do they attend the Deeds Office themselves or appoint a correspondent? If they are using a correspondent, this may slow their process down.
- Do they have a dedicated Deeds Office clerk to follow up, check ups, who attends to lodgement and removal notes?
- Are they willing to meet in person; and in person confirm their bank account number and exact spelling of their email address.
- Will documentation containing banking details be hand delivered?
- Will all documents being attached to emails be password protected?
- Will they be telephonically available to the purchaser whilst the EFT of the purchase amount is being done?
- Are they ok with the purchaser paying a small amount first; and once that is telephonically confirmed as having been received by the conveyancers, only then is the remainder of the purchase price paid.
- Will they carry out checks that estate agents involved are licensed?
- Are the conveyancing lawyers involved in property sales as well?
- Are they willing to assist with the drafting of an offer to purchase?
- Look for online reviews and ratings. Have they popped up on HelloPeter? Ask them for client testimonials.
