Lawyers that do Wills & are will executors near you
It is critical that you check that your lawyer is a member of the Legal Practice Council.
Are you looking for a lawyer/attorney to draft a will for you, and to serve as will executor when you die? Here is a list of lawyers who do wills in Cape Town. Experience and efficiency counts, as does the avoidance of errors. These lawyers have all previously participated in National Wills Week. Email lawyer@capetownlawyer.co.za if you are an attorney doing wills and want to get onto this list. Being on this list does not constitute an endorsement; please carry out a full due diligence before hiring a will attorney.
Are you worried about getting overcharged? Ask your preferred lawyer what they will charge, and then think about the following:
- For a standard simple will without complications a lawyer would typically charge from about R1000 to draft it for you.
- Lawyers are usually willing to draft a will for you for free, if you are appointing them as executor of your estate when you die; in which case they usually charge abotu 2.5% to 3.5% of the value of the gross assets in the estate.
- If the attorneys will be transferring a property to your heirs, navigate to our deceased estate property transfer costs calculator to see what you should be getting charged for transfers on property your heirs are inheriting.
<
Note: If you are looking for a lawyer who does deceased estates, most lawyers who do wills will also do deceased estates and are willing to serve as executors. It is often useful to choose a lawyer to be executor who is also a conveyancer, so that they can take care of any property transfers themselves.

What type of lawyers are best for wills?
Estate planning lawyers are often the best ones to hire to set up your will; as they simultaneously will be able to weigh up iother methods of leaving your assets to your loved ones and the tax efficiency of the various methods; they are also usually willing to serve as will executors and be trustee of any trust fund.
Reasons people update/redo their wills
- Assets have changed, e.g. they may have inherited a mansion, or sold their house which they had stipulated in their will that they would leave to somebody.
- Beneficiaries may have died or there may be new beneficiaries, e.g. new children or a new spouse.
- Their old will may have had onerous conditions, for example it may have been set up by a bank who appointed themselves to be executor at high fees, which the testator has realised can be improved on with another, lower fee, executor.

Speak to key people in your will
After you die you wont be able to do this.
Speak to executor/s
Make sure that the people who you think would make good executors are willing and able to serve as executors; and what fees they would receive for doing this (or are they prepared to act as executors for free).
Speak to beneficiaries
After you have drawn up your will (or even better before) speak to the beneficiaries, let them know who the executors are, let them have a copy of the will. The last thing you want is for there to be uncertainty and fights after your death.
