Damages due to the supply of unsafe or defective goods
Under the Consumer Protection Act, you can claim against retailers for damages due to the supply of unsafe or defective goods. The CPA allows you to claim for injuries or loss caused by defective products, regardless of negligence on the part of the supplier.
Take photos of the object, the packaging, your receipt, and any injuries. Keep the object as evidence.
File a complaint with the retailer directly, explaining what happened and requesting they cover your dental expenses.
If the retailer does not respond satisfactorily, you can escalate your complaint to the Consumer Goods & Services Ombud. They handle disputes between consumers and suppliers.
